Adolescent Skin and Litigation

AARGHHHHHHHHHH!!

And whiskers!

And mood swings.


I've been having the weirdest sleep patterns. I know that part of it is the ungodly hour of the morning that I must get out of bed, part of it is hormones, part of it is continuing pain in my left knee that never has healed properly, part of it is that I'm always anxious.

Now that most of the legal shit is over, I should be less anxious, but that's not usually how I work. During all the long, drawn out legal process I wasn't as edgy as I am right now.

I'm weird. I admit it.

In July, the judge handed down his decisions... all the medical bills from continuing treatment related to my left knee were to be paid. I was to be reimbursed for the surgery I paid for myself in December, paid for time lost from work, all my attorney's legal fees were to be paid, and the remainder of the permanent partial disability on my left knee was to be paid as well.

None of those things happened. A new player, Charitable Inc. sent me a bunch of letters denying all of it.

Evidently they can't do that.

So now, in addition to whatever they were already ordered to pay by the judge, they must add a penalty for not paying in a timely manner.

Every piece of paper I get is almost undecipherable. I mean, they're written in English, punctuated correctly, and perfectly legible, but I have no idea what the fuck they mean. All written in legalese.

So I finally managed to be calm enough to talk with my attorney and gained some understanding of what is going on.

It boils down to: I will get some sort of settlement. It's being hashed out by my attorney and the Humanitarians, and we may or may not be able to come to an agreement.

It has never been about personal gain, and it isn't now, either. What it's really about is that I'm pissed about how I was treated, I am pissed that there are actually legions of kind and generous people JUST LIKE them who make money out of shitting on injured workers.

This is one crazy world. Seriously.

    Ugh. What you've been through. And now having to fight them at your (their?) expense to get the money owed. Ugh. It's no wonder you're anxious. I try to be as optimistic about life as I can be, but you've had a protracted battle that has reminded you on a daily basis that there are awful people in the world who blithely go about their day crapping on humanity for a living. It must be hard to remain as upbeat as you sound in your blog when dealing with that. You are a very strong person. I admire you.

    1. Don't admire me! I have been living a more and more withdrawn life as this shit has dragged out... I'm finally starting to feel human again.

      But I've never lost my sense of humor. I have spent a bit of time laughing at some of the legal antics.

      The deliberate lateness of ol' Al adding things after the official record was closed, the lie about Dr Slice and Dice charging x amount for a deposition... what a moron.

  4. You know, I reckon something like 'on our side' from your local news would be VEEEEEERY interested in this. They do that in this area and get very fast results because they shame the people on camera.. you know, or the today show.. not that you need any more anxiety, but this is ridiculous. They were ORDERED to pay 3 months ago and tried to tell you they wouldn't for a COURT ORDER!?! Argh.

    1. Well, the thing is, I don't want to drag my company name into this. My company isn't the one responsible for the fucking... although you'd think that they'd want an insurer who adds to their reputation rather than subtracting from it.

      I know that if I were in charge of a work comp department for a large company I'd try really hard to make sure my people were cared for and taken care of properly, though.

  5. Right up to the very END, Work Comp pulled it's shit with my husband.
    COLA's are suppose to be paid No Later than thirty days ( if my memory serves me correct )after they come out in October each year. They (the idjuts) played "smart ass" and took 2 months to send the COLA in our weekly check ,to which our attorney decided to teach them a lesson and took them to court for the delay. I know it's only a slap on the wrist for these A Holes, but it was another 2K in our pocket PLUS the COLA and our attorney got his fee also for their stupid shit. (P.S. any one out there reading this that gets a WC COLA, hear ye, hear ye...call your attorney if you don't get your COLA within thirty days. Their "game playing" could mean extra $ in your pocket. :0)

    1. One of my friends knows work comp inside and out. My case is one that is brought up on occasion when s/he is providing advice to an injured person.

      Yeah, deliberately vague, don't want to get anyone in hot water.

  8. Had they done what they were meant to do in the first place, which is the reason they exist, it probably would have saved them money. Girl, if you can afford to stick with the fight, stick with it! I wish my son could have. He got screwed nine ways to Sunday! And, because he settled (for very little money) he will never be able to get the back surgery he so desperately needs.

    1. I can afford it because it's not costing me any money. In Oregon one does not pay his or her attorney in a work comp case. The only way an attorney gets any money from the case is to win. Then they get a percentage.

      Makes them work harder.

Maybe one day one of these bone heads will fall down the steps of the courthouse, hurt themselves... I hope they have a good lawyer because they will get exactly what they are giving.. SHIT!!

      But I do believe that shit eventually catches up, and when you've spent your entire adult life crapping on people, you will eventually get what you deserve.

      I'm sorry I won't be able to see it happen.
      Or at least probably not. I move in different circles than Al and his Clan of Shitweasels.

    I'm pretty sure all species of weasel feel pretty insulted right now. ;)

    If there was one field of law I hated most, it was probably Workers' Comp. Some of the longest, most drawn-out cases I ever did were WC. Oh, and of course it was always pure bullshit on the insurers' part each time. *sigh*

    Yup. That's their job - shit on you. It doesn't matter that they're paid to insure the workers. They'll fight paying out on a legitimate claim until the sun dies.

    I hope your claim gets paid before that happens.
